UPDATED: 13-Year-Old Arrested for Armed Robbery After Victim Shoots Him

The teen was released into his mother's custody.

A 13-year-old suspect was shot in the hand by an employee of the Garlic City Club early Tuesday after allegedly trying to rob the victim with two other individuals, according to the Gilroy Police Department.

Police said they received a 911 call reporting gunshots in the area of 40 Hornlein Ct. at 2:25 a.m.

The trio reportedly approached the employee while he was in his car, two of them armed with “unknown types of handguns.” After demanding money from the victim, the employee “retrieved a loaded firearm from inside his vehicle and fired at both suspects, striking at least one suspect,” police said. The victim was unharmed.

Deputies from the Santa Clara County Sheriffs Office aided Gilroy police in searching for the three suspects, finding the 13-year-old with a gunshot would to his hand in the area of Forest and Serafino Streets. Police said the suspect was treated at St. Louise Regional Hospital.

Detectives interviewed the teenager later that morning, arresting him for attempted armed robbery. After consulting with juvenile probation, police released the suspect into his mother’s custody pending court proceedings, citing his injuries and cooperation with the investigation.

The suspect’s identity is not being released due to his age, police said.

The other two suspects are still at large. One is described as a White or Hispanic male, around 18 years old and 120 pounds, five feet, five inches tall, wearing a dark blue sweatshirt and blue jeans. The other is also a White or Hispanic male around 18 years old, of unknown height, wearing a dark hooded sweatshirt at the time of the incident, police said.
