DA's Office to Review Investigation Into Toddler Shooting Death

The Gilroy Police Department has completed its investigation into the death of 3-year-old Preston Orlando and will send its report to the DA's Office by the end of the week.

The investigation into the apparent accidental shooting death of 3-year-old , son of Gilroy resident and San Jose Police Department officer Brandon Orlando, is now in the hands of the Santa Clara County District Attorney's Office.

"Our initial investigation has been completed," said Sgt. Chad Gallicinao of the . "We're basically done on our end and are preparing it for their review."

Gallicinao said the department's findings should make their way to the DA's office before Friday.

After their review of the GPD's report, it falls on the DA's Office to ultimately decide whether charges will be filed, Gallicinao said.

The GPD won't be releasing any further details about the case, either.

"Any additional release of information will be made by [their office]," Gallicinao said. "We will not be releasing any more information than we already have at this time."

Preston . Police have kept a tight wrap on details surrounding the toddler's death, including who owned the .45-caliber semi-automatic pistol that took Preston's life. The firearm . 

The GPD's investigation was as "objective and thorough" as possible, Gallicinao said, with personnel dedicated to the case "from day one."

"We wanted to make sure the report was able to be reviewed by the DA in a timely manner in line with county protocol," he said of the methods employed by the department in developing its report.

While the DA's Office couldn't give a specific time frame for how long it will take to complete their investigation, Steve Dick, a supervising deputy district attorney who is in charge of the case, said his office will work diligently to review the GPD's findings.

"We're going to get it done as soon as possible, but we really can't say for sure when our review will be done," he said.
