Gilroy Rape Case Sent to DA

A Gilroy woman is accusing her boyfriend of rape and of giving her an STD.

The Gilroy Police Department has forwarded a rape accusation to the Santa Clara County District Attorney's Office, Sgt. Pedro Espinoza told Gilroy Patch.

On the evening of Feb. 5, a woman, 22, went to the Gardner South County Health Clinic for treatment of an STD. During her visit to the clinic, she told the doctor that she was sexually assaulted by her 21-year-old boyfriend.

Both the victim and the accused rapist were interviewed by Gilroy police, but "they determined there was not enough evidence to make an arrest on site," Espinoza said.

The DA's Office will review the case packet and will either ask detectives to conduct further interviews, drop the case, or make an arrest, Espinoza said.
